You understand and agree that by posting your Content to the Site or Service, the Content including your name, questions answered, tags, links, photos and all other Content that you voluntarily post, add, or submit to the Site or through a Service, will be open to the anyone on the Internet and may be found through search engines, scrapers, crawlers and aggregators.

Users of the Site may post comments that will be stored in your profile. You will have the right to delete and block further contact from any user with whom you do not wish to communicate. myBigz will send you a notice when you receive a comment. You will also receive email notifications when users of the Site request that you become their contact. You have the right to choose who can contact you, and who can see your email address. You are solely responsible for your interactions with other users of the Site or Service and myBigz is not responsible or liable for any such communications or interactions.

You may not Post inappropriate Content on the Site. The following is a non-exclusive list of the kind of Content that is inappropriate and prohibited on the Site. myBigz reserves the right to investigate and take appropriate legal action, in its sole discretion, against you if you violate these provisions, including without limitation, removing the offending Content from the Site and Service and terminating your account and/or access. 1. promotes racism, bigotry, hatred or physical harm of any kind against any group or individual or that is otherwise offensive to the online community;

   1. a description of the copyrighted work or other intellectual property that you claim has been infringed
   2. an electronic or physical signature of the owner of the copyright or the person authorized to act on behalf of the owner of the copyright or other intellectual property interest
   3. a description of where the material that you claim is infringing is located on the Site
   4. your address, telephone number, and email address
   5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
   6. your statement, attesting made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

We are not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to your or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Site and/or in connection with the Service. Under no circumstances will the myBigz be responsible for any loss or damage, including any loss or damage to any Content or personal injury or death, resulting from anyone's use of the Site or the Service, any Content or Third Party Content posted on or through the Site or the Service whether such communications or interactions occur online or offline.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO COMPANY FOR THE SERVICE DURING THE TERM OF MEMBERSHIP, BUT IN NO CASE WILL THE COMPANY'S LIABILITY TO YOU EXCEED $30. YOU ACKNOWLEDGE THAT IF NO FEES ARE PAID TO COMPANY FOR THE SERVICE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM MYBIGZ, REGARDLESS OF THE CAUSE OF ACTION.
   
   CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.


6. Governing Law; Venue and Jurisdiction - By visiting or using the Site and/or the Service, you agree that the laws of the State of Connecticut, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and myBigz or any of our affiliates.

These Terms of Use constitute the entire agreement between you and myBigz regarding the use of the Site and/or the Service, superseding any prior agreements between you and myBigz relating to your use of the Site or the Service. Failure myBigz to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. If any provision of this Agreement shall be deemed unlawful, void or unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
